If you are an individual who meets the definition of asylee, you may be permitted to remain in the U.S. by applying for asylum within a year of your entry into this country. What Is the Definition of an Asylee?
An asylee is a person who fears persecution or who has suffered persecution in his or her native country (or country of last residence). This is a person who is unable to obtain protection from the persecution from his or her present government.
Persecution may be based on:
- One's race
- One’s religion
- One’s nationality
- One’s membership in a particular social group
- One’s political beliefs or opinions
When seeking asylum, you may include your spouse and children under the age of 21 on your application. You may apply regardless of your current immigration status or how you entered the U.S. This type of asylum is referred to as affirmative asylum processing under the U.S. Citizenship and Immigration Services (USCIS).
Asylees who are found to have participated in any type of persecution based on the above will not be granted asylum by the USCIS.

West Palm Beach Deportation Defense Attorney
Working to Protect Your Future in the U.S.
The threat of being removed from the U.S. is one of the most distressing situations that can occur to non-citizens. If you are facing deportation, you are no doubt worried about what this will mean for yourself and your family. You likely have little knowledge of potential legal options or how you can fight removal.
Find out how we can help defend you against deportation by contacting us at (561-533-6650.
You should understand that deportation proceedings do not automatically mean you will be removed. Certain options may be available to you that can be used in your defense. You will need the assistance of an experienced immigration lawyer who can review your case and determine your options. At Custer Law Group, our West Palm Beach deportation defense attorney can provide you with the skilled and determined legal support necessary to help you seek removal relief.
Reasons for Deportation
Living in the U.S. for non-citizens is a privilege and not a right. You are bound by the terms of your visa as well as U.S. law. If you violate the terms of your visa or state or federal laws, you can be legally removed from the country.
You may be deported if:
- You are found to have entered the U.S. illegally
- Your visa expired and you failed to have it renewed
- You move without providing your new address to the USCIS
- You are convicted of criminal activity, especially crimes of moral turpitude
- You violated immigration laws, such as entered into a fraudulent marriage for a green card
What is the Procedure for Deportation?
You will receive a Notice to Appear (NTA) if immigration officials wish to start deportation hearings against you. These proceedings are a civil matter—not a criminal one. An attorney will represent the U.S. government in the hearings, and you will not be provided an attorney as in criminal cases. Because of this, you should hire an immigration lawyer who can challenge the government’s case with appropriate legal actions.

The Green Card Process in the U.S.
In order to obtain a green card, you will need to fit into one of the eligible categories set up by U.S. immigration law.
You may be eligible to apply for a green card in the following ways:
- As a spouse or family member of a U.S. citizen or current green card holder
- As the fiancé(e) of a U.S. citizen once you have been married in the U.S.
- Through employment as an immigrant worker of a U.S. company
- As an immigrant investor who has invested or is in the process of investing $1,000,000 to create or expand a U.S. business
- As a refugee or asylum-seeker
- Through humanitarian programs, such as for victims of abuse, crime, and human trafficking
- Through other specialized categories
Understanding all of the intricacies of the green card application process can be daunting and, if your application contains errors, omissions, or lack of detail, could result in delays or denials. To avoid this, you should seek professional legal help from a green card lawyer.
What to Do After Receiving Your Green Card
fter you are approved for your green card, it is important to know that you can use your card for readmission to the country after a trip abroad that is shorter than one year. If you are abroad for longer than a year, you will need a reentry permit.
Additionally, as a lawful permanent resident, you will need to renew your card after ten years. You will also need to replace your green card if it is lost, damaged, or stolen. For replacing or renewing a green card, lawful permanent residents would file for I-90.
If you have a green card as a conditional permanent resident, you would need to remove your conditions to permanent residency after two years. This involves two different depending on if you arrived in the U.S. for family-based or business-based reasons.
- For family-based immigration situations: You would file Form I-751, or the Petition to Remove Conditions on Residence
- For entrepreneur-based immigration situations: You would file Form I-829, or the Petition By Entrepreneur to Remove Conditions
Both of these must be filed during the 90 day period before the card expires.
Can a Green Card Be Revoked?
it is very difficult to revoke a green card, but not impossible. Your lawful permanent resident status can be revoked due to a number of factors.
Factors that can lead to the revocation of your Green Card include:
- Taking actions indicating you are abandoning your permanent resident status. These can include moving to another country, staying outside the United States for over 183 days, or declaring yourself as a non-immigrant on tax returns.
- Engaging in certain types of criminal activity, including crimes of moral turpitude, drug crimes, and aggravated felonies.
- A discovery of fraud in your Green Card application. A common example of this is marriage fraud.
If your green card is revoked, you could face deportation from the country. If your green card has been revoked or you have concerns over losing your permanent resident status, reach out to Custer Law Group right away.

The EB-5 Investment Program
While the immigration process is often used to keep families together and bring skilled workers into the country, it can also be used to introduce new investment opportunities into the economy. The EB-5 program allows immigrants to buy a visa.
Under this program, as an investment entrepreneur, you (and your spouse and unmarried children under the age of 21) may be eligible for a visa if:
- You invest $1,000,000 in a commercial U.S. business ($500,000 if the business is in an area needing economic growth)
- You create at least 10 full-time jobs for U.S. workers
You may be in the process of investing or have already invested in a new business, one that is restructured, or you may be expanding a current business. You must also demonstrate that you will take an active part in the business, though it is not required that you control it. The business may be located anywhere in the U.S. and you must maintain your investment and participation in it for a minimum of three years. Generally, you are not restricted as to your source of investment funds as long as they have been legally obtained.
EB-5 green cards are limited by the U.S. government to 10,000 per year with 3,000 of those set aside for investment in economically-disadvantaged areas.
